1. GENERAL TERMS1.1. This offer governs the relationship between WayUSA Inc., the Student, and the Representative, with regard to the administration of the ELTiS test in an online format.
1.2. Acceptance of this agreement is confirmed by agreeing to participate in the test and submitting the registration form.
1.3. WayUSA Inc. is registered under the laws of the United States, with its official address at: 2483 Coney Island Avenue, Brooklyn, NY, 11223, U.S.A.

1.5. This agreement is made in English and Russian. In case of discrepancies, the English version shall prevail.
2. PURPOSE AND REQUIREMENT OF TESTING2.1. Taking the ELTiS test is a mandatory first step for all applicants to U.S. high school programs organized with the support of WayUSA Inc., including both public and private schools.
2.2. The purpose of the test is to assess the Student's level of English proficiency in order to determine academic readiness and appropriate school placement.
3. TESTING CONDITIONS3.1. The test is conducted online, on a date and time agreed upon with the Representative after confirming participation.
3.2. The Representative is responsible for ensuring that the Student has the necessary technical setup (computer, internet, webcam, microphone, etc.).
3.3. The Student must follow all rules of conduct during the test, without external assistance or violations of academic integrity.

4. RIGHTS AND OBLIGATIONS4.1. The Representative agrees to:
- Accept the terms of this offer;
- Ensure the Student is prepared for testing;
- Provide accurate and complete personal information.
4.2. WayUSA Inc. agrees to:
- Conduct the test at the scheduled time and provide access to the platform;
- Review the results and provide an English proficiency summary;
- Maintain confidentiality of Student data.
5. LIABILITY5.1. WayUSA Inc. is not responsible for technical failures on the Student’s side (e.g. internet issues, equipment malfunction).
5.2. In cases of misconduct (cheating, unauthorized assistance), test results may be invalidated.
5.3. Retesting may be offered at the discretion of WayUSA Inc. under mutually agreed conditions.
6. FINAL PROVISIONS6.1. This agreement is governed by the laws of the State of New York, USA.
6.2. All disputes will be resolved through good-faith negotiations. If unresolved, they shall be referred to the appropriate court of jurisdiction in the State of New York.
6.3. This public offer is valid indefinitely until modified or withdrawn by WayUSA Inc.
